Abstract (EN)

It's stated in the paragraph 4 of Article 127 of the Constitution that the resolutions of the objections and the audit about their losing relevant to gaining the title of organ are done by judgement. Parallel with the regulations in the Constitution, in Article 32 of Law numbered 2575 of the State Council, on the article 24 of the law on the Council of State it is featured that the Council of State examines the claims about losing the title of organ of the bodies who are elected by special provincial administrations, municipalities and adjudicates it. It's not the question that the amotion and termination which are forms of losing the qualities of being organ, are subject to judicial review but the process of amotion and termination must be made by judgement itself. In this study it has been tried to put forward some of the deficiencies related to amotion of elected organs of local administrators in the light of judical decisions.In the study the topic has been examined in two parts. The first part is generally referred to local administrations. In second part of the study, the status of amotion of the organs who are elected to local administrations is handled.
