Abstract (EN)

Merve Bihter AKICI, Inventions Made in Higher Educational Institutions and Publicly Funded Projects, PhD Thesis, Advisor Associate Professor Burçak Yıldız, 237. The subject of this study is inventions made in higher educational institutions and publicly funded projects. Study discusses the inventions that are created in higher educational institutions, and public funded projects pursuant to clauses 121 and 122 of the Industrial Property Code respectively. Pursuant to clause 121, clauses relating to employees' inventions will apply to the inventions made in higher educational institutions. In other words, these inventions are deemed as employee inventions and higher educational institution becomes the right holder of the invention. In this respect, this study analyses the conditions and requirements of an invention which is created in a higher educational institution. Clause 122 of the Industrial Property Code regulates the inventions made in publicly funded projects. Pursuant to this clause if the individual benefiting from Project funding does not claim ownership or does not select their rights in writing within one year of receipt of the notification, the funding public entity can claim rights over the invention. In this respect, this study analyses publicly funded project concept, features of funding entity and the individual receiving funds and aspects of the invention. Additionally, commercialization of these inventions is discussed in this study.
