Provisions relating to relations with the non-muslims in Zaydī fiqh and comparision with Hanafī fiqh

The Propose of the following thesis is an analysis and reveal of similarities and differences between Zaydi and Hanafi law school on issues related to international relations named "Kitab al-Siyar". The main sources of the research are two books, Tajrīd for the Zaydi faqih al-Muayyad Billah Ahmed ibn al-Husayn ibn Harun, written in the classic period of Zaydith fiqh and Mukhtasar forthe Hanafi faqih Abu al- Husayn Ahmad ibn Abu Bakr al-Quduri, who lived at the same classic period. The research method is a comparative study both of the works by the different ways. The research work consists of the introduction and three parts. There are talked about choice of the theme, limitation, method of the research, bibliography and common information about law of the Islamic states in introduction. The first part is about authors of the works Tajrīd and Mukhtasar, and the Zaydi and Hanafi law schools, and other important works written regarding these schools and areas of their popularity. Second part is devoted to the general forms of the above mentioned works, books, which were an inspiration of them, including comparative study of the Works by the literary language and method of writing. Comparative there made a comparison of the siyar parts of Tajrīd and Mukhtasar, choosing Tajrīd as a main goal.
