Marriage in Zaydi fiqh and comparision with Hanafi fiqh

Abstract (EN)

This study, which focuses on the verdicts on marriage in Zaydī and Hanafī jurisprudence, tries to determine the differences and similarities in the provisions of both madhabs. Chapters on marriage from Muayyad-Billâh ibn Husayn ibn Hârûn's Tacrīd is selected as an example of Zaydī jurisprudence and Ahmad al-Qudûrī's Mukhtasar as an example of Hanafī jurisprudence. The study consists of three chapters: the historical developments in both madhabs are discussed in the first chapter and in the second chapter, the selected texts are compared in the framework of kitabu'n-nikâh style in terms of format, method and tone. In the third chapter, the parts of these books on marriage is compared. It is seen that the texts are similar in terms of format and method, while Mukhtasar is more concise in terms of its tone. The verdicts on marriage show that both madhabs are close to each other, yet there is a considerable amount of differences.
