Abstract (EN)
Human rights, as accepted, to be the common rights of all human beings, human rights have been shaped according to unique, a world views of each particular community and reflected in the constitution of the society as the fundamental rights and freedoms. The fundamental rights and freedoms stated under Constitution of Turkish Republic and Constitution of the European Union have also been formed in line with the characteristics of their age. Among these fundamental rights and freedoms, freedom of expression occupies a privileged position since it bears vital role in the exercise of other rights. ?Comparison between 1982 Constitution and Constitution of the European Union with respect to freedom of expression within the framework of human rights? is the main topic of this thesis.In the first part of the present study; preparation stage of 1982 Constitution has been focused on. Terms such as rights, fundamental rights, human rights, freedom of expression have been conceptually analyzed and their reflection on 1982 Constitution has been explored. In the second part, the stages that European Union undertook in human rights, starting from the idea of creating a union in Europe, have been presented within the scope of historical progress of the Union. Constitution EU constitution draft and its aftermath have been explained. In the third part, the point reached in Turkey-European Union relations has been discussed within the scope of historical process achieved so far. İn this part, the definition of EU law system and its departures from international law has been explained. in the European Convention on Human Rights (ECHR) which is a reflection of freedom of expression in Constitution of the EU In the conclusion part, general evaluations on this topic have been made in the light of such facts.Key Words: European Union, Constitution of the European Union, 1982 Constitution, Human Rights, Freedom of Expression, Harmonization Laws, Progress Reports.
