Abstract (EN)
Climate change can be described as a global problem with many problems. Climate-induced displacement and migration is one of these global problems. These displaced persons are named as "climate refugees" in the literature. However, there are no legal grounds and practices for people who have had problems to migrate because of climate change. Since they are not considered as refugees in the legal field, they cannot benefit from the fundamental rights granted to refugees. The main reason for this situation, which creates a big gap in terms of environmental law and human rights law, is the limitations in the definition of refugee in the "Paragraph (2) of Article 1 of the 1951 Geneva Convention on the Legal Status of Refugees. Increasing environmental disasters are causing the number of climate refugees to increase. Despite this, no change has been made in international law yet. Ultimately, climate change continues to affect migrants, and this problem has turned into a global problem that concerns all states, regardless of political preferences. Based on this information, the status gap arising from the fact that the concept of "climate refugee" is not recognized in international refugee and asylum law will be examined. The issue of climate migration focused on the right to life will be examined within the framework of environmental rights and the legal procedures to be applied in this direction will be discussed. By explaining what states should do within the framework of climate agreements, recommendations will be made on how to take precautions against climate crisis. It is aimed to raise awareness in the academic field by providing information on the legal status gap of the concept of climate refugees. As a method, the literature will be searched and data from climate and migration related reports will be utilized. As a method, by making a literature review data from climate and migration related reports will be utilized.
