Our universities are centers where scientific production and cultural accumulation thrive, and where different ideas come together to discuss more significant issues for the country. Generally, like public institutions and organizations, universities also have a working system and order. Public institutions and organizations establish their working systems by referring to a law or regulations, thus ensuring work discipline and order. This situation is also applicable to universities. Similarly, public institutions and organizations carry out their processes with their employees. All the tasks and processes performed by these employees take place in areas where the state continuously provides services. Therefore, employees need to perform their tasks with maximum attention and adhere to the working principles of the institution they work for. Maintaining industrial peace and regulating the rights and legal status of employees are crucial in public institutions. For this reason, specific discipline rules are defined for all institutions. In this way, discipline provisions for academic staff working in universities were also regulated in Article 53 of the Higher Education Law No. 2547, accepted on November 4, 1981, and published in the Official Gazette on November 6, 1981. With this regulation, the discipline provisions, procedures, and principles that academic staff members working in universities must comply with were established. However, since the publication of the law, Article 53 has undergone changes from time to time, both due to amendments to the law and decisions of the Constitutional Court. This study aims to evaluate the controversial aspects related to the discipline provisions for academic staff in universities. With this study, guidance is intended to be provided to both administrators and investigators when conducting disciplinary investigations.
