Abstract (EN)
The internet, having an important role in every field of our daily lives, facilitates life. However this technology gives rise to tackling problems as well. Especially some basic problems, growing rapidly as of the emergence of the internet, are new forms of works, conversion of work according to the new technology, infringement of rights of authors? and related rightholders such as duplication, replication and publication. Insufficient and ineffective legal and technological protection is the other focal point of this problematic sphere. Along with this crucial issues, the transboundary character of the internet also complicates the application of provided measures.European Union have taken important steps for effective regulations to deal with the legal complications of the internet. It is important for the legislation in this field to be effective not only at national level, but also at international level. It is essential to sort out these problems which are arising from infringement of intellectual property rights on the internet, because it impedes the free movement which is one of the main goals of the Community. European Union still harmonizes national laws of member states to sort out the problems through community instruments such as regulations and directives.Turkey also engaged in harmonasing its national laws to these directives and regulations because of the negotiation period with the Community. In this thesis, we tried to analyse the connection of the internet and infringement of intellectual property rights under European Union law and Turkish Law.
