Abstract (EN)
Construction Contract In Remuneration For Land Share is not a contract specifically regulated under the Code of Obligations. It is a mixed contract which includes elements from Freeland Contract and Real Estate Sales Contract, which are regulated under the Code of Obligations. In Construction Contract In Remuneration For Land Share, the owner of the real property is under the obligation to turn over his/her land share to the contractor, while the contractor undertakes the obligation to turn over the designated independent parts of the building constructed under the contract. Namely the parties have mutual rights and liabilities arising from the contract. In Construction Contract In Remuneration For Land Share, defective work gives rise to the warranty liability of the Contractor, in which case the real property owner may have recourse to the rights arising from this liability. In cases of impossibility, the contract becomes terminated and also the party who is in breach of contract or defaults in fulfillmentof the contractual performances gives the other party the right to terminate the contract.
