Abstract (EN)
Construction contract in return for land share that is dealt with its aspect related to contractor's liability in most of scientific studies also attributes considerable responsibilities to land owner who is the other party of the contract. But land owners who believe they cannot be held liable for any responsibility and obligation other than transferring land share and contractor will be held liable instead of them for everything, are not aware of this reality most of the time. In fact contrary to land owner's beliefs about the legal aspect of contract, both as people who are the other party of the contract and as people who will possess the building work, they are liable to so many people with different legal bases. Land owner's responsibilities to contractors comprise just a part of the total responsibilities that they have, and besides that, responsibilities of land owners usually cannot be understood from the text of the contract. In this thesis, it is aimed to determine what kind of legal procedures should be followed by land owners for demands asserted by both contractors and third parties and whether there is a way to obstruct to this demands at the stage of making contract and if possible, what kind of conditions should be laid down in the contract for this to happen by identifying the borders of responsibilities.
