Abstract (EN)
In the Turkish Armed Forces, there exist many works for the maintenance andrestoration of present materials such as weapon and equipment. In such places approximately30.000 people are employed for various services. Briefly, in such places expressed as militaryplaces of employment labor legislation and other related laws are applied to employees?working conditions and labor relations like civilian companies in Turkey. All labor relationsare executed under the frame of this legislation.Meanwhile, places of employment in the Turkish Armed Forces, unlike from otherorganizations has its own procedure originating from a hierarchical structure. t is acceptedthat they may be asked to work in shifts, and their working hours may be altered as Per thegeneral principles of working for the Armed Forces. Furthermore, their legal status is definedso that their liberties can be restricted by the enforcement of military disciplinary rules andregulations. The ones who has been finally condemned by a military court will be imprisoned.With regard to the growing need for specialization in the Armed Forces, it is important todefine which laws the growing number of the Civil workers are subject to in terms ofpersonnel affairs, discipline and penalty regulations.In this article, we made a comparative study of the applications of the terms ofCollective Labour Contract and the military laws to the workes in the Turkish Armed Forces.it is pointed out in which conditions the employer should apply disiplinary regulations withinthe frame of the military laws together with the Collective Labour Contract terms.Key Words : Worker, Military person, Disiplinary regulations, Military Penal Code.
