Abstract (EN)

Today, the rapidly increasing understanding of open and transparent administration has contributed to the termination of the confidentiality and closure in administration and to the construction of a citizen-oriented administration concept. In this context, the role of citizens in their relations with the state has increased and significant developments have taken place in the direction of supervision and participation to public administration. One of the steps taken in this process is the recognition of the right of petition, information and apply to public auditor as a constitutional right. In this regard, the importance of the citizen having the right to petition, information and apply to public auditor in supervising public administration and ensuring transparency and openness in administration need to be revealed. In particular, one of the most important steps of the harmonization process with the European Union Acquis in Turkey with regard to public administration is the adoption of legislation regulating the right to information and the right to apply to the public auditor. These two rights, were included in the Article 74 of the 1982 Constitution, which regulates the right to petition, under the title of 'Petition, Right to Information and Apply to Public Auditor', together with the amendment of the Constitution of 2010. With this research, that is data obtained from secondary sources are analyzed based on the literature review and petition, right to information and application to public auditor, which is a tool for increasing transparency practices in public administration and citizen supervision of public administration, are examined in the case of European Union and Turkey. The review is based on the content of the legal regulations (purpose, scope and rights terms of use) and their effects on the transparency of the administration and the supervision of the administration.
