Termination and liquidation of the regime of participation in acquired property

This thesis study, which deals with the subject of "The Liquidation and Termination of the Regime of Participation in Acquired Property", was prepared as a master's thesis in Dicle University, Institute of Social Sciences, Department of Private Law. The concept of "Regime of Participation in Acquired Property" emerges as one of the most important reforms in Turkish Law. As a result of the termination of the marriage union, the "Regime of Participation in Acquired Property" brought along a new understanding, especially for women to be included in a more equitable property sharing process. This thesis consists of two main parts. In the first part of the study, generally the types of property regimes were counted, then the "Participation Regime in Acquired Property", which entered our legal system as a legal property regime with the Turkish Civil Law No. 4721, was explained, its principles were counted and the distinction between acquired property and personal property was examined. In the continuation of the first part of the study, the "End of the Regime of Participation in Acquired Property" were counted and the characteristics and results of each of these termination states were explained. In the two and last chapter, the subject of "Liquidation of the Regime of Participation in Acquired Property" is discussed and the characteristics of the liquidation process, its results and some special cases regarding the liquidation are examined. In this thesis; In the light of scientific studies, different views in the doctrine, and high court decisions, an examination and evaluation was made.
