Abstract (EN)
War and peace have always been part of essential debates of interstate history and legitimacy lie at the bottom of these debates in its core. Although the concept of just war which expresses the legitimacy of war is western-centred; there have been resources about the legitimacy of war, which there are approaches based on legitimacy in them, since early ancient times. Epistemological, conceptual and theoretical differences are found in the core of differentiation in these approaches. Like all religions, states and civilizations have a theory of war and law of war, Islam has a distinctive doctrine of war and a law of war based on it. Islamic law of war is shaped under the skin of the Quran and Sunnah. I classified the Islamic law of war under two heading "the doctrine of war" and "the law of war" as mentioning doctrine and application. The doctrine of war covers the Quran and Sunnah with Fiqh and Kalam which are based on them. The resources related to belief-related and intellectual backgrounds of war in Islam are investigated. Additionally, the law of war covers how the application of war in the Quran and Sunnah; and it is analysed with their resources under three main headings as "the recourse law of war", "the law of in-war" and "the law of post-war". I applied Quran, and Nasafi's Tafsir and Ebussuûd Efendi's Tafsir for detail, in addition to some works with scholarly value such as Bukhari and Muslim for Hadith resources and the Islamic Law of Nations for Fiqh resources. I aimed to draw a general frame of war in the Quran and Sunnah.
