Abstract (EN)

Just as in the past, the legitimacy of the methods used by intelligence and security agencies to gather information has been the subject of debate. Intelligence activities can sometimes result in violations of fundamental rights and freedoms. On the other hand, especially with the end of the cold war, new security approaches emerged due to threat perceptions. Today, without intelligence activities, it is not seen possible to perceive and prevent threats beforehand. The main subject of our study is whether the information obtained through the intelligence channels can be accepted as evidence in the criminal proceedings. Criminal Procedure is an area in which the interests of the individual and the social interests are in conflict. The state, which punishes the individual for the sake of the society, must respect the basic rights of the individual in the collection and evaluation of the evidence, act in accordance with the law, and constitute the example of lawful conduct. For this reason, intelligence should carry out its activities under certain rules and should be subject to legal review.
