Abstract (EN)
The employer's right to manage is from sources specific to labor law. This source maintains order in the workplace and in business relationships. The employer's right to manage, which is an important and frequently encountered right in practice, is the bottom of the ladder in terms of the hierarchy of norms. The employer's right to manage is not an unlimited right. For this reason, the boundaries of the employer's right to manage should be determined correctly. As labor law developed and the scope of hierarchical regulation of higher norms expanded and became casuistic, the limits of this right became narrower and clearer. The employer must exercise this right, observing the limits of the right of management. Otherwise, it is possible to face financial and moral compensation, imprisonment or judicial fine and disciplinary punishment. In the study, the limits of the employer's right to management, the legislative infrastructure, practical examples and events that have been transferred to the judiciary have been evaluated. The aim of the study is to evaluate the limits of the employer's right to management in the context of developing technology, changes in social life and changes in legislation and to give a new perspective to new problems that can be transferred to practice and the judiciary.
