Qualifications required for the service in terms of right to enter public service

In the 70th article of constitution, which regulates the right to enter public service, qualifications sought by law and secondary legislation in entering public services is named as qualifications required for the service. In the aforementioned provision, the rule of not making any discrimination among the citizens in entering public services, other than the qualifications required for the service, has been adopted. In terms of right to enter public service, qualifications required for the service functions as the selection of persons to public services of those who are suitable or worthy to be given public service. Qualifications required for the service are regulated in the Civil Servants Law No. 657 for civil servants, and by special law, Presidential decrees and secondary legislation for other public officials. The Constitution accepts the principle of legality with respect to regulating the qualifications required for the service. However, provided that the basic principles and the framework are determined in the law, the qualifications required for the service can be regulated with the regulatory administrative acts. In point of Presidential decrees, as a rule, no regulation can be made regarding the qualifications required for the service. Nevertheless, in matters that the Constitution specifically envisages to be regulated by a Presidential decree, regulation can be made by a Presidential Decree if the relevant Constitutional provision clearly permits making regulations on the qualifications required for the service.
