Effects of public procurement legislation on the efficient use of financial resources

In this study, the missing aspects and faulty applications of Public Procurement Legislation in the efficient and productive use of financial resources obtained for public expenditures were investigated through a content analysis and document review. To this end, the financial resources obtained by the administrations within the Scope of Republic of Turkey General Management were determined in the final budget reports between 2010 and 2014 first, and then Public Procurement Followup Reports of the same period were reviewed, establishing the amounts of procurements made under Public Procurement Law. In order to determine the missing aspects and faulty applications of Public Procurement Law that includes the fundamentals about the use of financial resources, the canceled procurements between 2010 and 2014 were reviewed in detail. Moreover, the appeals and complaints made to the Public Procurement Authority and the Public Procurement Authority decisions were also reviewed and the missing and faulty applications generally performed by administrations and their financial dimensions were established. Accordingly, it was seen that the Public Procurement Law no. 4743, which has the greatest say in the use of country's financial resources, caused financial losses due to missing provisions and faulty applications, and there were articles and applications which needed to be changed or added in accordance with the efficient and productive use of resources.
