Personal data protection and data security in comparative law in the electonic telecommunication sector

In the current century, information and communication technologies are developing rapidly every day and this rapid development is changing the classical ways of thinking, working, shopping and people's habits. The changes brought about by Society 5.0, the "Super smart society" where cyberspace and physical space are highly integrated, are now being discussed. Global in scale, the prediction that the number of internet-connected devices will exceed 30 billion by 2025 and that the world telecommunications market will reach a size of 4,5 trilyon US Dollars once again reveals the importance of this field. With developing technologies, data production has reached gigantic dimensions. Data has become the fuel of our age. With the rapid development of technology, the electronic communication sector continues to change in a way that grows and develops day by day and is always open to innovations with technological developments. These developments also show the importance of regulations on freedom of communication, confidentiality of communication, processing and protection of personal data. In our study, firstly, the definition and basic elements of the concept of electronic communication will be given, and then the principles that should be observed in the provision of electronic communication services will be explained. Among these principles, the principle of confidentiality of communication and the principle of protection of personal data will be emphasised, and information on the concepts of data and big data, the elements and usage areas of big data will be presented. Regarding data security in the protection of personal data, which constitutes the main theme of our study; the need for the protection of personal data, data security and the methods applied in ensuring data security will be examined in detail. The protection and security of personal data in the electronic communications sector, in particular data specific to the electronic communications sector, will be examined, and detailed analyses will be provided on network and information security standards, technical methods applied, risks, detection of data vulnerabilities and measures. Information on regulations and rules specific to the electronic communications sector will be provided, and detailed assessments will be made on technical methods, processes and capacity building, especially on issues related to network and iv information security. Developments in the field of cyber security and important studies in the field of cyber security in Türkiye will be included. The regulations of international organisations and developments in the protection of personal data will be examined in detail, and relatively new concepts such as the right to be forgotten and data portability will be emphasised. Detailed information about the legislation on the protection of personal data in Türkiye will be given and comparative evaluations will be made with the European Union General Data Protection Regulation. In addition, the regulations and practices of some selected countries in different geographies such as European Union countries, the United States of America and India will be examined, and the issues will be examined in detail by comparing the regulations of these countries with the regulations in Türkiye. The study will also put forward views on how the necessary protection can be provided in a balanced ecosystem between consumers, the state and the private sector to ensure the security of data in electronic communications.
