The security problem in modern democracies and rule of law

Throughout history, people have made an effort to be safe. In the past, this effort was only shown to ensure the safety of life and property, but in today's modern societies, it is also shown for the protection of fundamental rights and freedoms. The purpose of existence of the liberal sovereign is accepted as ensuring the security of individuals and the protection of their fundamental rights and freedoms. Liberal understanding believes that a balance should be established between the concepts of freedom and security by keeping them equal. This belief grants privileges and exceptions to the sovereign. Concessions form the ground on which today's state of emergency practices rise. The privileges used by the state to ensure security and the state of emergency it implements threaten the freedoms of individuals. This threat creates a security-based order that disregards democratic institutions and the rule of law. In this study, the position of the concept of security in liberal democracy is examined within the framework of the rule of law. For this study, the concepts of democracy, freedom and rule of law were examined respectively. Finally, the concept of security has been tried to be explained. Finally, with examples, the balance of freedom and security on the axis of the rule of law in today's liberal democracies has been examined.
