Abstract (EN)
With technology and information Exchange that became accesible and easier today, the livesand behaviors of the people have became in need of protection aganist interventions. For this reason, the crime of violting the right of privacy aims to protect the privacy, fundamental rights and freedoms of individuals. The right to privacy, paralel to the regulations in Article 8 of the European Convention on Human Rights, was protected by Article 20 of the 1982 Constitution and was regulated and protected as a crime in the Turkish Penal Code No. 5237 dated 01/06/2005. In the first part of the thesis the concept of privacy life, the content of the concept will be tried to be determined by evaluating it within the framework of both national and international law rules. It is aimed to concretize the concept with the decisions of the ECHR and the Supreme Court. In addition to the protection of the right to private life by criminal law, its relationship with other branches of law and protection they provide for violations will be included. In the second part, the crime of "violating the privacy of private life", which is ruled in the Article 134 of the Turkish Penal Code, will be examined in accordance with the crime theory and judicial procedure of the crime will be discussed by examining the material and moral elements of the crime, the reasons for compliance with the law, the qualified forms and special appearances of the crime. In addition, a general evaluation will be made within the scope of the Article 134 of the Turkish Penal Code by referring to its relationship with other crimes regulated in the ninth section of the Turkish Penl Code.
