Protection of personal data has a connection between human rights particularly with the right of self-determination. Besides, the protection of personal data affects other basic rights. Recently, with the help of the developments of the technology and the boom in the spread of using the internet, increase the importance of data protection. In order to provide the security of personal data and protect the dominance of the data subject over personal data, many regulations have been made in international and national fields. For this purpose, the Law on Protection of Personal Data No. 6698 has entered into force in our country. As defined in this law, personal data is any data associated with an identified or identifiable person. Processing of personal data means any operation which is performed on personal data. Processing of personal data could be an obligation in the personal data processing agreement. The legal character, specialities, terms and conditions of personal data processing agreement shall be determined not to face any problems. Despite the regulations, there are still facing the infringements of personal rights by processing personal data. The liabilities arising from the infringement of personal data and also the right of claim for pecuniary and non-pecuniary damages should be determined.
