Abstract (EN)

National and International Law Sanctions to Prevent the Financing Terrorism It is of great importance that the cooperation to be made within the framework of the fight against terrorism, which poses an international threat and negatively affects the international community, takes place at the international level. In order to eliminate the problem, the studies carried out under the leadership of the United Nations on cutting the financial resources of terrorist organizations made it possible to consider the financing of terrorism as a separate crime. On 9th December 1999, in addition to the adoption of the International Convention on the Suppression of the Financing of Terrorism in the United Nations General Assembly, the sanctions of the UN Security Council after the September 11th attacks started the process of adopting the financing of terrorism in national legislation. For the first time in Turkey, the crime of financing terrorism, which is included in the Anti-Terrorism Law Article No. 3713, was rearranged with the Article No. 6415 on the Prevention of the Financing of Terrorism and entered into force on 16th February 2013. Thus, in order to comply with the provisions of the United Nations Convention and to prevent the financing of terrorism by the states party to the convention and our country, it is aimed to determine the principles regarding the fulfillment of the decisions taken by the Security Council for the freezing of assets and the requests in this direction. As evaluated within the scope of the study, the terrorism financing legislation in Turkey is generally in line with the conventions and resolutions adopted by the UN. However, in order to prevent the crime of financing terrorism from being evaluated in the context of aiding terrorism in practice, some deficiencies in the legislation need to be eliminated. However, it would be appropriate to take into account the criticisms regarding fundamental rights and freedoms both in the Convention and the law.
