Abstract (EN)
This study examines the issue of joint child custody upon the termination of marriage union via divorce within the framework of Article No. 4721 of the Turkish Civil Code. In this respect, the aim, the legal quality, and the scope of the custody right, the emergence of the joint child custody concept and the regulation of the joint child custody in comparative law are analyzed in the light of international references regarding the joint custody issue. Having regard to these examinations, the study examines whether it is possible to enact joint child custody in Turkish law of domestic relations within the framework of current legal regulations, current stances in the doctrine, and the effects of related international references into domestic law, and then provides suggestions regarding the disputable parts of the issue.
