Abstract (EN)
This study compares the concept of theft crimes between the Islamic Jurisprudence and the Turkish Penal Code. The main difference between the Islamic Jurisprudence and Turkish Penal Code is that the first deals with the concept in a casuistic manner, while the latter prefers using a more abstract method. The main aim of this thesis is to make an attempt to rearticulate the penalty of the theft crimes stated in the Islamic Jurisprudence within the abstract method of the law in force. Both the Turkish Penal Code and the classic and contemporary sources of the Islamic Jurisprudence were used during the course of this study, while the comparison was presented within the system of the law in force.
