Abstract (EN)
This thesis focuses on the determination of the price in contracts of work and the rights of employers when the approximate amount is excessively exceeded. The study is structured into three main parts. The first part provides an overview of the definition, legal nature, and characteristics of contracts of work. The second part discusses the methods of determining the amount in contracts of work, highlighting the issues that arise when estimating expenses for works that span over a long period. The third part, which forms the core of the thesis, investigates the consequences of the excessive exceeding of the approximate amount in contracts of work and the rights of the employer in such situations, with reference to Article 482 of the Turkish Code of Obligations (TBK). This thesis aims to contribute to a better understanding of the legal framework governing contracts of work and to provide guidance on the protection of employers' rights in cases of significant cost overruns.
