Abstract (EN)

Turkish Civil Code No. 4721 and the Turkish Constitution place emphasis on the family institution which constitutes the basis of society. Therefore, various obligations are assigned to parties and authorities are defined to Judge in order to maintain the unity of family. Alimony obligation comes first among these obligations. Subject of this thesis is Temporary Alimony within Turkish Civil Code No. 4721. Saving and preventing the weak party from being in need is aimed with temporary alimony. Temporary alimony can be defined as the obligation for help to the needy partner and the children within the unity of marriage until the divorcing judgement is declared. Temporary alimony is under the heading of maintenance alimony. Decisions, regarding how temporary alimony is evaluated in practice, in the scope of up to date Supreme Court and District Court of Appeal, are included in this thesis. In this thesis study, firstly the concept and definition of alimony, types of alimonies and common features of all alimonies are mentioned. Afterwards, the study is finalized by examining temporary alimony in all aspects. Key Words: Alimony, Alimony Obligation, Temporary, Temporary Alimony, Temporary.
