Abstract (EN)

Personal data, which has become a monetary value in terms of commercial companies, began to be seen as a new oil of the economy. It is essential that the personal data, contained within the limits of personality, are protected against the danger of commodification. The right to request the protection of personal data against the threat of commodification has been adopted as a human right in Turkey as it is in many countries and the processing of personal data has been subjected to various legal conditions. The right to request the protection of personal data is in contract with several branches of law. One of these branches of law is the contractual law which is an essential part of everyday life in terms of individuals. In this study, unlawful processing of personal data in the context of contractual relations and the ways of protection were examined. In addition, the personal data processing agreement, between the 'Data Controller' who is the leading actor of the personal data protection law and the 'Data Processor' who is the other responsible subject in that law, is also one of the important issues examined in our work.
