The sample of provision change in the works of Zeylai and İbn Nüceym

In our thesis examined the concept of change in islamic law,it is dwellt on the essence of tegayyür(change) concept, its field, its necessity and the reasons that require change. Then, it is tried to scrutinize the social background of fatwas given by fukaha and maslahat on figh issues gone into a change. The concept of change is in a status of change of the latter in proportion to the former in case of comparison of two things with each other. It can be gone into this change for many reasons. It can be stated that the most efficient reason is custom. Two works we compare essentially in our thesis are two annotations written on work of Ebü'l-Berakat called Kenzü'd-dekaik and these annotations are Zeylaî's Tebyinü'l-hakâik şerhu Kenzid'd-dekâik and İbnNüceym's el-Bahru'r-râik şerhu Kenzid'd-dekâik. It is tried to analysed within füru works, what kind of change has happened over the past 200 years between these two work's copyright. While doing this, it is tried to compare the statements mentioned in the form of "in our times","in present time" about same issues in both books and identify the changed provisions.
