Abstract (EN)

Attorneyship (el-wekala bi'l-husumah) which has a substantial and detailed place on Islamic law of obligations, and which is a part of the attorney agreement, is an attorneyship given by client who is one of the parties gave to be represented on the court. This dissertation has examined the aforementioned legal transaction which is called 'advocacy' at the present time, with an emphasis on the internal client-proxy relationship. Adopted principles of the Islamic scholars on attorneyship which is the subject of both obligations and procedural law, have tried to be understood based of the literature on attorneyship. It has been demonstrated that Islamic law has some similar facilities with today's waged attorneyship in parallel with the development of the legal and economic relations. Moreover, I have aimed to track the legal development of the attorneyship from the sources of the early period of Islamic law to the legal reforms which is began with the Tanzimat. In that sense, it was noted that there was some concrete steps in the relationship of attorneyship in Ottoman law to today's waged attorneyship.
