The criminal liability of the President of the Republic in the framework of the 2017 Constitutional amendment

The criminal liability of the President of the Republic has long been a topic of discussion in Turkey. Turkey accepted a new government model with the 2017 Constitutional Amendment and completely changed the criminal liability of the President of the Republic. These amendments resulted in a different dimension of the discussions regarding this issue. Because currently the President of the Republic is in the center of the new government model and constitutes the executive branch alone. In this context, the President of the Republic has moved away, in terms of their legal status, from the role of presidency in the parliamentary system and is now closer to the role of presidency in a presidential system. It is of great importance how the criminal liability of the President of the Republic is regulated compared to the wide range of powers that the President of the Republic, just like a President in presidential system, has. Thus, in this study, firstly, the concepts of President of the Republic, and liability will be explained, then the historical development of the criminal liability of the President of the Republic in the Turkish Constitutional Law will be discussed. In second part of this study, the investigation phase of the President of the Republic's criminal liability in the parliament will be analyzed and the criminal liability of the President of the Republic in Turkey will be compared with that of the President in the USA. Finally, the trial phase of the President in the Supreme Court will be examined.
