Legal Search and Measure SearchMesut BİLENABSTRACTThis study one of High Bachelor?s degree?s thesis is a study of what search one oftrouble measure is, its aim, its practise and towards to state results and it occurs from fourparts.Search meaure has been arranged firstly at Penalty Adjudication Law and PoliceJuristiction and Authority Law and then in many locations. This study is especially towards tostate the measure of search by taking into consideration the arrangements of PenaltyAdjudication Law and Legal and Measure of Searches Regulations.During the studies,statements have been made by making comparison also related to Penalty AdjudicationProcess Law that has been gone into effect before Penalty Adjudication Law.Search is a measure that takes to find the secret and hidden as a goal and parts two oneof them is measure search and the other one is legal search. The legal quality of search and thefixing of the basic principals in search law is important because of that it is a process causesthe limitation of the basic rights and liberties of search. Because, the legal quality of searchand the basic principals in search law limit to responsibles for decision and practise during thetime of practise from decision. At the first part of the study, it has been examined that whatthe search is, its legal quality and the basic principals in search law.The step of measure services for the goal of prevention the crime. İt aims to find andcontrol the people who cause trouble and the things that cause danger in society by this goal.The search of measure is a process related to the area before a crime. Mentioned legal searchafter a crime is a process that is aimed at catching a suspicious or accused or finding theevidences of the crime. The process of search limits many basic rights and liberties. For thisreason, some provisions are requested to apply the measure. At the second part of the study,the goals and provisions of the search have been examined.Some special features are there for the person addressed, location and time of thesearch. Law has been arranged some exceptional regulations for the persons who is addressedfor the search, the locations where the search will be done and the time when the search willbe done. At the third part, the features in this meaning of the search have been examined.İt is necessary to act in the limits of legal search at the time of the practice of thesearch process. Otherwise, some basic rights and liberties would be limited in which way ofthe law will not permit. At the fourth part of the study, the practise and results of the searchand also especially the results of the illegal searches have been examined.
