The execution of judgments of the European Court of Human Rights

This study examines the root, structure and, particularly execution of the judgements of the European Court of Human Rights (ECtHR). In this study, it has been strived for enlightening the approach towards the execution of the judgments of the European Court of Human Rights in the international level and the effects of the Courts' judgments upon the domestic law of the states. In this regard, it has been tried to comprehend the logic of the execution process by reviewing the literature as well as the decisions of the Committee of Ministers of the Council of Europe and the European Court of Human Rights. Consequently, it has been concluded that, while executing the judgments of the European Court of Human Rights, it has mainly been required to take individual and general measures in the scope of principle of subsidiarity. On the other hand, it has also been seen that the judgments of the European Court of Human Rights sometimes face with non-execution. Therefore, the causes and results of the non-execution has also been assessed.
