Protection of digital rights of the children in social media within the scope of information technology law

The use of information systems has become widespread since the technological developments has increased. As the social media usage began to increase, methods of communication and sharing began to be carried out predominantly in the digital environment. The rights of personality and privacy of the people may be harmed when users share photos, videos, audio and texts. Within this context, children are also at risk since children may be exposed to dangers such as cyber bullying and abuse from third parties. Parents also engage in sharenting activities by sharing the personal data of their children on social media platforms. For these reasons, it is clear that children need protection on social media. There are protective cases stipulated in the Turkish Civil Code in order to protect the personal rights of the children. However, it is also possible to apply for protection within the confines of the Personal Data Protection Law. It is also possible to apply to the regulations stipulated by the Law No. 5651 on the Regulation of Publications Made on the Internet and Combating Crimes Committed through These Publications. In accordance with the "General Data Protection Regulation in European Union Law", children's personal data is protected. Protection is provided by the Data Protection Act in force in the United Kingdom, while the Federal Data Protection Regulation is in force in Germany. In the United States, "Children's Online Privacy Protection Act" has been adopted. In this study, personal rights within the confines of children's digital rights and the ways of protecting their personal data on social media were examined in Turkish law and comparative law.
