Crime of causing noise in the scope of environmental law

Noise has become a phenomenon that has negatively affected people's peace and life, especially in the last century. In fact, with the development of technology and the rapid increase in life, the sources and impact areas of noise have also increased rapidly. The number of public and private transportation vehicles, factories and industries, electrical kitchen equipment, ventilation equipment and health equipment is increasing day by day and these are becoming an indispensable part of human life. For this reason, the concept of "noise" has gained a special place in the category of "environmental pollution". The crime of causing noise is defined as a crime against the environment in Article 183 of the Turkish Penal Code No. 5237. Noise, which means unwanted and disturbing sounds, has negative physical, psychological and physiological effects on people. The legislative body has protected people's right to a safe and healthy life by prohibiting noise from harming human health. In the crime of causing noise, the Crime of Causing Noise will occur if the perpetrator deviates from the obligations stipulated in the law and creates noise that is likely to harm the lives of people in danger. At this point, two issues are taken into consideration. First, it is determined whether the noise deviates from the obligations under the law, and then it is determined whether the noise deviates from its role in helping human life, but in the second stage, there is a risk or negative impact.
