Abstract (EN)
Confiscation at Criminal Adjudicational Law means to abolition of ownership of the goods and give it to court of justice which is an evidence or would be evidence in case of the resistance of the owner. Confiscation, as a precaution of protection arranged in Criminal Adjudication law no: 5271 first book, 4. section, 4. part 123 and following articles. Protective measurements which sustain effective criminal adjudication and enable correct application of it at the end of the procedure and before the decison requiring acts to fundamental rights and freedoms are legal restrictions. It is possible to divide confiscation into two as simple and private. Private Confiscation: to confiscate biens immeubles, claims, published works, peiodicals, forbid to the distributions and sale of works published in Turkey or abroad, confiscation of the postal, fugitives, law firms, lawyer posts, computers, softwares, data set search and designate custodian fort he companies.In the fist part of the dissertation, confiscation term, the history of confiscation as a protective measurement, principles , the aim of confiscation are analysed. In the second part, confiscation in Criminal Adjudication Law discussed. In the third part the kinds of confiscation and retail of goods are analysed.Key Words: Confiscation, Protective Measurement, Criminal Adjudication Law.
