Özet (EN)
Introduction and Aim: Recently, there has been a rapid increase in claims for medical malpractice (malpractice). The number of lawsuits filed is gradually increasing. Therefore, medical malpractices are closely related to both health and legal science. Defensive medicine practices are increasing as a result of high compensation and long-term lawsuits as a result of physicians avoiding medical malpractices. In this study, it is aimed to evaluate the current knowledge levels of the future lawyers, prosecutors and judges, who are the parties of this subject, to increase their knowledge and contribute to the progress of the process faster and more accurately. Materials and Methods: In this study, pre-education questionnaire on Malpractice-Complication was applied to the trainee lawyers registered in the Diyarbakır Bar Association in 2019 to measure their level of knowledge. Afterwards, training was given and a survey was conducted again after the training. A questionnaire consisting of 12 questions with multiple choice and very correct answers was prepared. Content of the survey questions; Causes of malpractice, consequences of increased malpractice lawsuit, evaluation of the distinction between malpractice and complications. A pre-training questionnaire was distributed to 107 trainee lawyers. After the questionnaire was filled, trainee lawyers were given 4 hours of theoretical training. At the end of the training, the questionnaire was distributed again. Results: Participants who in the questionnaires they filled before and after the training: increased malpractice cases and anxiety about filing a lawsuit will lead physicians to defensive medicine, professional liability insurance will positively affect health services, decisions in the Forensic Medicine Institute about malpractice are objective, declared that universities should be experts in malpractice cases for a fee. They declared that their opinion that informed consent should be obtained in the case questions. Conclution: In our study, it was seen that trainee lawyers had insufficient knowledge about malpractice-complications. Due to the increasing interest and the number of lawsuits on this issue in recent years, law students should be given more education on this subject before graduation. We believe that it would be appropriate to support lawyers with seminars and conferences after graduation. Key Words: malpractice, complication, medical malpraktice.
