Abstract (EN)
ABSTRACTThe aim of our thesis is exspressing the thought and proposing the importance offreedom and studying the meeting and demonstration march which is the most dinamic onesof the means of spreading in democracy, human rights and constitutional law axis.With it?s aim, effects and results, the freedom of meeting and demonstration march iscomponent part of the social-political life in the democratic rule of law. It can?t be possible tosay democratic State where this right is not in assurance.The freedom of meeting and demonstration march is more effective in comparisonwith other means of exspressing thought because it has a collective qulity. But itseffectiveness is not only it is collective but also this freedom can be used by everyone and itdoesn?t need to the one has a certain economic and social power.With the freedom of meeting and the demonstration march has collective quality, ithas brought the result being threaten the order of public. On one side, the physilogicalsituations such as fury and excitement of the individuals who use the freedom has gainedimportance, on the other side; it has claimed responsibilty providing the balance between thefreedom and the order to the State. Because of all theese reasons, the individual, beingfaunded balance between the freedom and the order, it has brougt the result that meeting andthe demonstration march must be limited much more in compariosion with the order freedom.The right of meeting and demonstration march in constitution sets up a restrictiveregime which became compatible with the European Convention on Human Right by theamendments in 2001. But these amendments can?t be reflected on it?s Law as much as is due.While people using this freedom, the duty of the state is not just non-interfererence butalso to assure the safety of the participiants. This is the condition of the democratic rule oflaw.
