Abstract (EN)
The Hanafi madhab's approach to hadith narrations differed greatly from that of the Ahl al-Hadith school. The Hanafīs' strict attitude towards the acceptance of hadith narrations had a direct impact on the provisions of jurisprudence. There were disagreements on which of the hadith narrations narrated from the Prophet (pbuh) should be acted upon, the conditions under which the narrations should be accepted, the relationship between the hadith narrations and the verses of the Qur'an, as well as how the narrations should be understood and what the Prophet (pbuh) meant. In this study, the hadiths related to family law in al-Hidāya have been analyzed and an analysis of the sects' approach to these hadiths has been attempted. In this way, although a research has been conducted in terms of furūʿ provisions, the hadiths have been analyzed in terms of usul. In addition, the consistency of usul-al-furūʿ, the intellectual background of the mujtahids' fiqh activities, and some of the sects' views on usul, especially their approach to hadīth narrations, have also been tried to be revealed. In this context, the subject of the study isn't only the hadīth methodology and methodology of the sects, but also different aspects of fiqh. The hadith narrations analyzed are discussed in two sections. In the first part, the hadiths related to marriage and in the second part, the hadiths related to talāq were analyzed. After the hadith narrations have been analyzed, an attempt has been made to present the furūʿ and usul analyses respectively.
