Abstract (EN)

The freedom of expression is the most significant piece of basic rights and freedoms, and is necessary for democratic societies. It is the key point of every constitutional state. Furthermore, it is protected by democratic societies as the freedom of expression, because it has a great importance in Europe and in the whole world and when the provided freedoms are widen, the democracy of the states increase. This concept is criticised very much in Turkey and there are many cases of European Court of Human Rights against Turkey by regarding it. The politicial side of freedom of expression, one of the must-be protected freedoms, should be analyzed as much as the legal side of it. With the recent regulations, the freedom of speech in Turkey is being narrowed. Yet, it is debatable if these measures are enough.
