Abstract (EN)

The independence and impartiality of the judiciary is indispensable for rule of law. For this reason, the judges and public prosecutor have been given some safe guards, rights and privileges to perform their duties without any pressure and intereference. In addition, separate and autonomous arrangements concerning judges and public prosecutors are included in Turkish legislation. However, these rights and privileges granted to judges and prosecutors must be used in accordance with the requirements of the law and the profession. Disciplinary responsibility of judges and prosecutors have been regulated by law in order to make judges and prosecutors accountable, especially for judges and prosecutors who are prejudiced and acting as partiality and in a behaviour that is not suitable for the profession's honor and respectability. In this study, it will firstly be referred to the profession of judges and prosecutors and also the rights and obligations of the judges and prosecutors in the context of the disciplinary responsibility of them. Afterwards, the designation, determination and application of disciplinary punishments applied to judges and prosecutors will be scrutinized. In addition, ways to appeal against the sanctions will also be mentioned. Finally, by discussing the deficiencies and some mistakes in above-mentioned topics, some advices will be made to eliminate for manage the problems head on.
