The influence of the Mu'tazilite method of jurisprudence on the Hanafi method of jurisprudence in II-VI centuries

The usul al-fiqh developed in parallel with theology and the first issues of usul al-fiqh were generally addressed primarily by theological sects. In this respect, the Muʿtazilites, who played a pioneering role, directly influenced the views of the Iraqi Hanafīs on the usul al-fiqh through their theological principles. However, in the following centuries, both Samarkand and Bukhara's mashāyihs were aware of this influence and made some modifications to the views of the madhhab that were attributed to the madhhab through the Iraqi scholars. As a result of these discussions, although the weight of Bukharan jurists was felt in the Hanafī usul, which took its final form after the sixth century, Samarkand's scholars continued to criticize the other two groups of scholars over their theological views. Our study focuses on the influence of the Mu'tazilites on the Hanafī madhhab in their views on the methodology of fiqh, which continued through theological issues in the first six centuries of the Hijra. Our thesis consists of three chapters. In the first chapter, the relevance of the usul al-fiqh to the science of kalām is mentioned, followed by an examination of the Mu'tazilites and the groups of the mashāyihs who contributed to the development of the usul in the Hanafī madhhab. In the second chapter, the different views on usul on sharīʿa evidence, which are dealt with in three sections: the Book, the Sunnah, and Qiyas, are given in a comparative manner. In the third part, the views of the Mu'tazilites and the Hanafī madhhab are compared in the al-'alfāz issues.
