Abstract (EN)
Fiqh sects comprehensively made use of the principle of assembly. Assembly with the exception for the rule of repetition of decretal depending on the repetition of reason, is the attribution to a single decretal of many reasons. This study contains the principle of assembly depending on the comparison of Hanafi and Shafii sects. Our study comprises of two chapters. The prologue involves the subject, aim, importance and bibliography of our study. In the first chapter; lexical, term meaning and concepts and resources of assembly are included. In the second chapter is the pratice of assembly in the fields of prayer, transaction and punishment by the scriber of Hanafi and Shafii sects depending on islamic laws. Hanafi scribers prefer the principle of assembly which is unrelated to prayer but related to acts that are conducive to prayer. Besides, they prefer the assmbly in the case of acts that are considered prayer as a rule of istihsan. On the other hand, Shafii scribers prefer the principle of assembly without discrimination in the acts that are both prayer and condusive to prayer. In this study, we specifically tried to explain the fields that Hanafi and Shafii sects practised the principle of assembly by identifying the resources and evidences. Moreover, we tried to unfold the fields where the principle of assembly is practiced by these sects and the preferred views on it in the light of evidences. This study is prepared by taking anvantage of other Works written in the recent period about the related issue, particularly the classic fiqh Works of Hanafi and Shafii sects.
