Abstract (EN)
Due to its economic size, the public tenders are protected by administrative and criminal sanctions by the state. Administrative regulation and sanctions are regulated in Public Procurement Law No. 4734 and State Procurement Law No. 2886. In criminal law, "bid rigging" regulated in Turkish Penal Code No. 5237 (article 235.). In our work, the public tender process has been examined primarily and thoroughly. In the following sections, bid rigging crime is examined according to the crime theory. And determinations have been made whether the current laws played an active role in the fight against corruption or not.
