Evaluation of the Council of Europe Convention on the Prevention of Terrorism in the context of the protection of human rights

In this study, the Council of Europe Convention on the Prevention of Terrorism and its Additional Protocol were evaluated in the context of the protection of human rights. The scope of the study is limited to the Council of Europe Convention on the Prevention of Terrorism, its Additional Protocol and Principles on Human Rights and the Fight Against Terrorism. In the first part of the study, a general conceptual framework was tried to be drawn. In this context, in the first part of the study, the definition of terrorism, its history and stages of transformation, its characteristics, causes, types and the strategy of combating terrorism in comparative law are discussed. In the second part of the study, the arrangements in the Council of Europe's Convention on the Prevention of Terrorism and its Additional Protocol and the decision of the Committee of Ministers called Principles on Human Rights and Fight Against Terrorism were examined together. The main purpose of the examination is to determine whether the principles regarding human rights in the decision of the Committee of Ministers in the context of the decisions of the European Court of Human Rights and the Constitutional Court are regulated in the Council of Europe Convention on the Prevention of Terrorism and its Additional Protocol. In the third part of the study, the regulations in the Council of Europe Convention on the Prevention of Terrorism and its Additional Protocol are examined in the context of human rights. In the conclusion part of the study, deficiencies or inadequacies in the Council of Europe Convention on the Prevention of Terrorism and its Additional Protocol have been identified in the context of the protection of human rights and solutions have been presented. Thus, it is foreseen that it will contribute to the fight against terrorism in the context of the protection of human rights in international criminal law.
