Abstract (EN)
In the first chapter of this study about human experimentation and therapeutic trials; general concepts, principles, inconsistent use of terms concerning human experimentation and therapeutic trials and the conditions under which human experimentation and therapeutic trials would be in accordance with the requirements of the law in regards to both domestic and international legislation were examined. This study distinguishes between the crime of human experimentation and the crime of therapeutic trials, examining each in separate sections. Likewise, human experimentation and therapeutic trials were arranged and separated into two distinct crimes in the Article 90 of the part titled "Crimes Against Physical Integrity" of the second part titled "Crimes Against Persons" of the second book titled "Special Provisions" of the Turkish Penal Code numbered 5237. Human experimentation was examined in the second chapter, while therapeutic trials were examined in the third chapter under following sections; objective and subjective aspects of the crime, unlawfulness, culpability, forms of the crime, sanctions. In addition to human experimentation and therapeutic trials, different forms of human subject research were also examined. In the study, the importance of reducing the inconsistent use of terminology in the literature regarding human subject research has been emphasized, and the significance of conducting such research has been highlighted due to its contribution to the advancement of medical science and the improvement of the quality of human life.
