Abstract (EN)

This study aims to clarify the scope of The Principle of Disposition and its application field at labour judgment. Firstly, the parties, labour courts, the proceedings applied in these labour courts and the fundamental principles of a labour judgment relating with the Principle of Disposition are examined within the study. Throughout the next chapters, initiation and prosecution of a labour trial, the parties' power of disposition and conclusion of the case are tried to be discussed in the framework of the Principle of Disposition. The alienation of the subject, devoid of essence, lawsuit withdrawal, compromise, acceptance and renounce are tried to be examined in the context of a labour judgement. Finally, the impacts of the Principle of Disposition on the service detection actions are tried to be enlightened by using all these tools.
