Abstract (EN)
Islamic jurisprudence has ruled a vast geography over centuries and produced a very robust literature. A comprehensive understanding of this rich scholarship necessitates conceiving the fundamental concepts of fiqh. In this context, this study examines the terms of saman and qiymah within their real context of classical fiqh literature. In this study, saman is conceived as the consideration that bilaterally determined to exchange for the sold good in the sale, while qiymah means the market value of any good irrespective of its sale price. This study aims to examine the concepts of saman and qiymah, especially within the chapters of muâmalât, and to clarify the distinction between them. For this end, it attempts first to determine the terminological meaning of both concepts in the literature and to show how they are dealt with in the related issues of füru' al-fiqh.
