Abstract (EN)
With the entry into force of Law No. 6098 on Turkish Debt Law on 01.07.2012; Law No. 818 dated 22.04.1926 and Law No. 6570 dated 18.05.1955 on real estate rents were abolished. The new Turkish Code of Obligations required special arrangements for lease agreements for residential and pent-up premises and included this arrangement in the second division of the fourth part of the second section of the Turkish Code of Obligations. The attempt has been made to balance the tenant and the lessor with the arrangement made. Although the law, in general, has brought regulations that oversee and protect tenants; these arrangements made in favor of the tenants have brought innovations that give certain not unlimited possibilities to the lessor as well. One of the innovations brought on behalf of the landlord and arranged for the benefit of the tenant shows itself on the rents of houses and pent-up premises when contract ends unexpectedly. For this reason, under which conditions the lease agreement of the house and pent-up premises that can be seen on a daily life, can be terminated, were examined. Additionally, the differences from the law no 6570 on real estate leases and the definition of need and for whom the request for need can be accepted were evaluated. Our study consists of three parts; in the first part the lease agreement and the application area of the lease agreement for the residence and pent-up premises will be explained. In the second part, unexpected ending of the lease from need for houses and pent-up premises tried be explained,; in the third and last section, the terms and results of the ending of lease agreement for houses and pent-up premises will be explained. In this context, the termination of the lease by means of an eviction case for the residence and pent-up premises, which is set out in Article 350 of the Turkish Code of Obligations 6098, the eviction case for the termination of the lease of residence or workplace for the need of the lessor, will be explained based on article 351 of the Turkish Code of Obligations Key Words Turkish Code of Obligations 6098, Houses and pent-up premises contract, End of Term Due to the Necessity, Residence Needs, Workplace Needs, Property Receiving Person
