Criminal procedural system regarding organized crime

The aim of our dissertation is to explain the extraordinary procedural system regarding organized crime, and to assess whether its adoption is reasonable or not. In pursuit of this aim, present legislation and recent amendments have been analyzed in light of comparative law, and the necessity of an extaordinary procedural system specific for organized crime has been questioned. The dissertation only deals with the concept of "organized crime" with regard to its specific procedural system; thus, its sections were determined in accordance with the stages of criminal procedure. Accordingly, the first part of the dissertation comprises pre-investigative phases, while the second part concerns the investigation stage. The third and last part explores the courts in charge of the prosecution and trial of organized crime within a historical perspective. The method of research consists of the analysis of legal doctrine, jurisprudence of Turkish, foreign and international courts, international conventions, legislation, preparatory acts of the parliament, and legal comparison. The study at hand presents the procedural system regarding organized crime in historical perspective and determines positive and negative aspects of the present system. Regarding controversial topics within the dissertation, different points of view are presented and personal opinion of the author is explained. The thesis approaches the procedural system in organized crime in depth, and concludes that extraordinary procedural rules should not be adopted for specific offences because such rules do not comply with human rights standards or with principles of criminal procedure law.
